What is the difference between legislation and guidance?
Legislation you must comply with, guidance you can chose to do it differently. However in the UK whilst HSG 274 Parts 1, 2 and 3 are described as guidance it is always better to follow the guidance as then you don’t have to prove that your alternative is equal or better.
I don’t know who is responsible on my site for managing Legionella
In the UK the Duty Holder has to appoint a Responsible Person. This Responsible Person should have sufficient authority, competence and knowledge of the installation to ensure that all operational procedures are carried out effectively and in a timely way. If I break the law what would I be charged with?
You would be charged with a breach of the Health and Safety at Work etc Act 1974 or COSHH 2002 or the Management of Health and Safety at Work Regulations. You might not even have Legionella bacteria in your system, it might be a simple as not having a system for legionella treatment.
